Terms of Service — TY For This LLC

Agreement to Terms

By accessing our website or using our services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

Description of Services

TY For This LLC provides AI-powered marketing and front-desk services for small businesses, including:

• Website design, hosting, and maintenance
• Meta (Facebook and Instagram) ad campaign build and management
• AI front desk: call answering, missed-call text-back, SMS and web chat response
• Appointment booking and calendar automation
• Lead follow-up automation
• Automated Google review requests

Service Plan and Billing

Bison Digital subscription plans

Every plan includes a conversion-built website with hosting and maintenance. Automations (missed-call text-back, review requests, follow-up sequences) are included from the $297 plan up. The AI receptionist that answers and books calls is included on the $497 AI Front Desk plan. Meta ad campaign build and management is available as an add-on and is only included where your order form says so.

• Your selected plan’s monthly rate ($97, $297 or $497 USD), billed in advance on the same calendar day each month.
• No setup fee. No contract. No minimum term.
• Your website is included with an active subscription and remains hosted for as long as that subscription is active.

Billed separately, not included in your monthly plan

• Ad spend. Billed directly by Meta to your own ad account, which you own and control. We do not collect or mark up ad spend. You set your own budget.
• Usage. Phone minutes, SMS, email, and AI processing, typically $10 to $40 per month depending on your call and message volume. A $10 usage credit is included every month.

Payment

• We accept major credit cards and ACH.
• Payment is due monthly in advance.
• If a payment fails, we will attempt to reach you. Service may be suspended 7 days after a failed payment and may be terminated 30 days after a failed payment.

Cancellation

• You may cancel any month. Email us at hello@bisondigitalagency.com or use the cancellation link in your billing receipt.
• No written notice period, no cancellation fee.
• Cancellation takes effect at the end of your current billing period. Partial months are not prorated or refunded.
• On cancellation, your website, ad management, and AI services are deactivated at the end of the paid period.

14-Day Guarantee

If you are not satisfied, request a refund within 14 days of your first subscription payment and we will refund that first subscription payment in full.

Scope and limits:

• The guarantee applies to your first subscription payment only.
• It does not cover ad spend. Ad spend is paid by you directly to Meta from your own account and cannot be refunded by us.
• It does not cover usage charges.
• It does not cover any subsequent monthly payment.
• One guarantee per customer and per business.
• Requesting a refund cancels your subscription effective immediately.

Apart from this guarantee, all payments are non-refundable.

Results

We do not guarantee any specific result. We do not promise a number of leads, calls, bookings, jobs, or any level of revenue, and we do not promise a return on ad spend. Marketing results depend on your market, your budget, your pricing, your responsiveness, and factors outside our control.

The 14-day guarantee above is the only guarantee we offer. Any other promise is not binding unless we put it in writing and sign it.

Client Responsibilities

You agree to:

• Provide accurate business information
• Respond to our communications in a timely manner
• Maintain your own Meta ad account and payment method for ad spend
• Not use our services for illegal, deceptive, or harmful purposes
• Comply with all applicable laws, including CAN-SPAM and TCPA regulations
• Review AI-generated communications where accuracy is critical

Intellectual Property

• Websites and digital assets we create for you are licensed to you for use with our services.
• On full payment of all outstanding balances, you may request transfer of your website assets.
• TY For This LLC retains all rights to its templates, frameworks, automations, and proprietary tools.
• You retain ownership of your Meta ad account, your business content, and your customer data.

Limitation of Liability

TY For This LLC is not liable for:

• Indirect, incidental, or consequential damages
• Loss of revenue or business opportunities
• Third-party service outages or account actions (Meta, Google, GoHighLevel, carrier networks)
• Results from marketing campaigns

Our total liability for any claim is limited to the amount you paid us in the 30 days before the claim.

Disclaimers

• AI tools may produce imperfect output. Human review is recommended for critical communications.
• We are not responsible for third-party platform changes, policy changes, or account suspensions (Meta, Google, GoHighLevel, Apple, and others).
• Ad account approval and ad delivery are controlled by Meta, not by us.

SMS Terms

By providing your phone number and opting in, you consent to receive SMS messages from TY For This LLC related to our services. Consent to marketing messages is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages.

SMS services are intended for individuals 18 years of age or older.

Mobile information, including phone numbers and SMS opt-in consent data, is not sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes.

Our handling of your information is described in our Privacy Policy.

Governing Law

These Terms are governed by the laws of the State of Utah. Any dispute will be resolved in the state or federal courts located in Utah.

Changes to Terms

We may modify these Terms at any time. We will give 30 days notice of material changes. Continued use of our services after that notice constitutes acceptance.
